Lindsay Masonry - Was a "No Show"



Lindsay Masonry, Ontario, Canada, was a "No Show" -

Our house was suppose to be bricked in June, then July and then in September we were told that " we were next ". September 21, 2013, we received an email that "Dean couldn't do our house".

Meanwhile we did everything he asked, including buying sand, bricks, lintels, sills and cement. All bundled up and paid for in the yard since July!

The cement cannot wait until next spring.
We also had the insulation installed outside of our house and the porches poured, because we didn't want Lindsay Masonry to have to wait for us to do it ourselves. The insulation cannot stay exposed all winter, because the taped seams are already coming apart waiting for Dean since July.

What I don't understand is " how can people walk away from their commitments?"
Dean's word and contract means nothing!
I don't think we are Lindsay's first customers that he has done this to either.
It was too easy!
He didn't even have the courtesy nor the maturity of giving us the news in person.
Dean's work came highly recommended by a brick salesman, but if Dean doesn't show up to do all of the work that he has a contract for, then he really isn't any good, is he?

The additional cost of accelerating preparations to be ready for Dean in July 2013 (as per his request) is about $3,500.00.

The un-necessary costs incurred because of Dean's cancellation are not yet properly understood, but I do know that the out of pocket costs will be in excess of $2,000.00 and are likely to be in the range of $5,000.00 depending upon the still unknown condition unused bricklaying supplies & materials.
Out of pocket costs include the work to remove external penetration hardware (air vents, water pipes, etc) reseal the exterior expired house wrap & tape that will need to be done, masonry cement lost because of water damage that occurred over the winter.

The cost of the project completion delay (6 to 9 months) is estimated at about $1,000 per month.
And yes, I am still considering suing Dean Lindsay.
The overall financial cost to us of his decision to delay from June to September then ultimately walk away from his commitment last year is in the range of $10,000 to $25,000 ... I will not have a reasonably accurate cost until the brick work is finally completed.

His action has also delayed the final inspection (completion) of our house by nearly a full year.
